Probate is the court-supervised legal process of proving a will's validity, appointing an executor (personal representative) to gather assets, pay debts an taxes, and distribute the remaining property to the beneficiaries, ensuring a deceased persons estate is settles according to their will or state law if there's no will.
Purpose of Probate (after death)
•Validates the Will: Proves the will is the deceased's true last testament.
•Appoints Executor: Formally grants legal power to the named executor to manage the estate.
•Manages Assets: Gathers, inventories, and protects the deceased's assets.
•Pays Debts & Taxes: Ensures valid creditor claims and taxes are paid from the estate.
•Distributes Property: Transfers remaining assets to heirs or beneficiaries.
•Winds Up Affairs: Officially settles the decedent's financial and legal matters.
Probate is Necessary when a person dies with assets titled solely in their name (e.g., real estate, bank accounts without a payable-on-death designation). To legally transfer ownership of "probate assets" to beneficiaries or heirs, or when no will exists (intestacy), probate distributes assets according to state law.
