Paternity Rights in Florida: What Unmarried Fathers Must Do to Protect Their Parental Rights

Florida law treats married and unmarried fathers very differently. When a child is born to a married couple, the husband is automatically presumed to be the legal father. But for unmarried fathers, there are no automatic parental rights — even if your name appears on the birth certificate. Without taking the right legal steps, you could be denied custody, visitation, and the ability to make decisions about your child's life.

Does Signing the Birth Certificate Establish Legal Paternity in Florida?

Signing a birth certificate in Florida does not automatically establish legal paternity or grant parental rights. To have enforceable legal rights as an unmarried father, you must either sign a Voluntary Acknowledgment of Paternity (VAP) at the hospital — which does create a legal presumption — or obtain a court order establishing paternity through a formal paternity action.

How to Establish Legal Paternity in Florida

You can establish paternity in Florida through a Voluntary Acknowledgment of Paternity signed by both parents, or through a paternity lawsuit filed in circuit court. In a paternity action, the court may order DNA testing, establish legal parentage, and simultaneously address time-sharing, parental responsibility, and child support. Once paternity is established by court order, you have full legal rights and responsibilities.

Without established paternity, the mother has sole legal custody. She can relocate with the child, make all medical and educational decisions, and deny you visitation — and you'll have no legal remedy.
